Jambonex provides services to clients all around the world and therefore has the responsibility to protect each client and provide them with the best services available. The following guidelines are designed to insure optimal and lawful services to all Jambonex clients without efficiency compromise.

These terms of service apply to Customers, subscribers, affiliates and visitors of the Jambonex website and services.

Content
All services provided by jambonex may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Kenyan, Sweden, USA or EU law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statue. The subscriber agrees to indemnify and hold harmless Jambonex from any claims resulting from the use of the service which damages the subscriber or any other party.

Examples of non-acceptable content or links:

* Pirated software
* "Illegal MP3's"
* Hackers programs or archives
* Warez Sites
* Child Pornography
* Adult sites

Due to the large scope of information that may be provided through our servers, we cannot monitor, warrant or verify the accuracy of information relayed to the users. Should you find inaccurate, unsuitable, offensive, or illegal material in our servers, please contact abuse@jambonex.com

Jambonex will have the final word as to what constitutes a violation of this provision.

Unlimited Traffic/Hits & Server Resource Usage
Jambonex is pleased to offer our clients unlimited traffic/hits, and server usage. Unlimited Traffic/Hits refers to the number of visitors to your website, NOT the amount of bandwidth/data transfer. Your account is still limited to the allotted bandwidth/data transfer included with your selected package. To maintain the integrity of our service the following traffic/usage limitations apply.

* Sites with banners, graphics or cgi's running from their domain being used on other domains.
* Sites with immense graphic archives or galleries.
* Sites offering immense download archives, such as .zip, .tar, .ra and .GZ.
* Sites running large chat room gatherings.
* Sites using more than 20% of system resources

If you do not qualify for unlimited traffic/hits, your account may be required to be upgraded, or, Jambonex may move your site to a different server, to reduce the load on the server you are currently residing... Jambonex will be the sole arbiter as to what constitutes a violation of usage limitations. Bandwidth/data transfer will go unmonitored until you reach your account limit. At any time Jambonex may move your site to a different server, to reduce the load on the server you are currently residing.

Chat Rooms
Jambonex does allow clients to install their own chat rooms. However, these tend to be large system hogs and may fall into the usage limitations clause. We do provide a html based cgi chatroom that runs without hindering the performance of the machine for others. You are free to run your own chat script, as long as it does not hinder server performance.

Cron Jobs
Jambonex does allow Cron Jobs to be conducted on our servers.

IRC
Jambonex does not allow IRC or IRC bots to be operated on our servers.

Multiple Connections
Multiple telnet and ftp sessions are allowed, on a single hosting account.

Idle Timeouts
Jambonex may disconnect any idle connection to the network.

Average timeouts are
FTP - 300 seconds
Telnet - 2 hours

(SPAM) Commercial Advertising - Email
Jambonex has zero tolerance to Spamming, or the sending of unsolicited email, using an email address that is maintained on Jambonex machine for such purpose is STRICTLY prohibited. For general reference, we consider spam any email that is sent to more than 10 people at a time that did not ask for it to be sent to them.

Server Abuse
Any attempts to undermine or cause harm to Jambonex server or customer is strictly prohibited. Jambonex will pursue legal action to the fullest extent for all abuse of the Jambonex Network.

Suspension/De-Activation
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. Jambonex reserves the right to remove any account without prior notice. If Jambonex deactivates your account(s) for violating policy, your will forfeit your rights to a refund...and none will be given. No refunds for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offence. Serious offences may cause immediate de-activation. Jambonex will also suspend your account on the grounds of delayed hosting payments.

This Site may contain links to other sites on the Internet that are not owned or operated by us. We only provide these links for your convenience and therefore have no responsibility or liability for their policies and privacy practices. Links do not imply that jambonex.com endorses authenticity of their material or products, is affiliated, or associated with them.

Hosting
The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on Jambonex, and the right to increase the amount of resources given to plans at any time.

When an account is cancelled, all copies of the Web site and e-mail files are permanently and irretrievably removed from our servers.

If an account has been suspended for non-payment, it will only be reactivated upon payment of all overdue fees.

We do not provide support for open source applications available in Fantastico. Please refer to the relevant forums and developers websites.

The Jambo plan is payable on yearly basis. You may be refunded upon cancellation of the Jambo hosting plan for the months ahead that you had not yet implemented, however your domain’s name registration or renewal cost will be deducted in full for that year.

Domain Names
The registration or renewal of any domain name by Jambonex on behalf of a Customer is subject to,
(i) The Customer providing all information needed to complete such registration,
(ii) The availability of the domain name,
(iii) The domain name not being in violation of any applicable law, rule, statute or regulation,
(iv) The domain name not being in violation of any policy of the Chosen Registrar,
(v) Any fees or costs for such domain name registration being paid in advance by the Customer and
(vi) The Customer's continued compliance with any and all Jambonex Terms of Service.
(vii). Once a domain name has been registered or renewed through Jambonex, no refunds will be given for the domain registration or renewal fee.
(viii). The Customer has full ownership rights over any domain name registered or renewed through Jambonex, where the domain registration fees have been paid in full by the Customer. In the event of failure to pay renewal fees, Jambonex will either retain possession of the domain name or leave it to expire. We shall not be held responsible for expired domains
(ix) Jambonex will retain the billing information of your domain for auto renewal purposes. You may maintain your domain’s registrant, technical and administrative contact information. Your domains contact should be uptodate at all times.
(x) You may have your domain registered elsewhere as long as you pay in full the Jambo plan’s hosting costs.

Privacy Policy
Jambonex will not use any personally-identifiable information about you (that is, your name, address, telephone number, or email address) outside the communication between you and Jambonex unless required by law enforcement agencies. Jambonex may use your information to contact you with promotions and announcements of interest to you or if we have questions about your account.

User is responsible for maintaining the confidentiality of all domains login information. Difficult to guess passwords are highly recommended. Jambonex shall not be held responsible for data loss of any kind. Users are responsible to back up their data under all manner of service interruptions. The services we offer do not cover warranty of any kind in view of the scope of internet that the services will not be interrupted, error free and accurate. Jambonex shall otherwise strive to offer cutting edge services as is available from our users and parent servers at all times.

This Site may contain links to other sites on the Internet that are not owned or operated by us.
